Terms of Service

These terms and conditions govern the sale of products by Memory Canada, a business of Lobcom Canada Limited (DBA memorycanada.com), through memorycanada.com. By submitting an order, you accept these terms. We may change them at any time without prior notice, and the version posted at the time you place your order is the version that applies.

Listings are invitations to buy, not offers to sell

The products and prices listed on this site are advertisements inviting offers of purchase, not offers to sell. All orders are subject to our review and acceptance.

Order acceptance

An order confirmation email is not acceptance of your order, and does not confirm an offer to sell. Memory Canada may accept or decline any order, for any reason, at any time after it is received. Our acceptance is confirmed only when we send a shipping confirmation. All orders must be paid for by an acceptable payment method before they ship. We may request additional information to verify an order before accepting it.

Prices

All prices shown on memorycanada.com are in Canadian dollars and do not include applicable taxes unless stated otherwise. Standard shipping within Canada is free on orders of $50 or more and $9.99 on orders under $50; expedited shipping, where offered, is priced at checkout. The price charged is the price shown at the time the order is placed.

Pricing and description errors

Despite our efforts, a small number of products on this site may be listed with an incorrect price, an incorrect description, or incorrect availability. If a product's correct price is higher than the price shown, we will either contact you for instructions before shipping or cancel the order and notify you. We are not obliged to honour an order placed at an incorrect price, and we reserve the right to correct an error and cancel the affected order even after the order has been confirmed and payment taken. Where we cancel, you receive a full refund.

Availability and quantity limits

Stock levels shown on this site are indicative. Products may sell out or become unavailable between the time you place an order and the time we process it. We may limit the quantity of any product sold to a single customer or household, and we may decline or cancel orders that appear to be placed for resale.

Payment

We accept the payment methods displayed at checkout. You confirm that you are authorised to use the payment method you provide. Payments are processed by Shopify Payments and other third-party processors; Memory Canada does not store your full payment card details.

Taxes

Applicable GST, HST, PST, or QST is calculated at checkout based on your shipping address.

Product warranties

All products sold by Memory Canada are genuine and brand new. Any manufacturer warranty is offered by the manufacturer on its own terms. Memory Canada makes no warranty of its own beyond the rights set out in our Refund and Return Policy and any rights you have under applicable consumer protection law, which are not affected by these terms.

Data on storage products

You are responsible for maintaining your own backups. Memory Canada is not liable for the loss, corruption, or cost of recovery of any data stored on a product purchased from us, whether the product is defective, returned, exchanged, or otherwise.

Limitation of liability

To the extent permitted by law, Memory Canada's total liability arising from the sale of a product is limited to the purchase price you paid for that product. We are not liable for indirect, incidental, special, or consequential damages, including lost profits, lost data, or business interruption. Nothing in these terms limits liability that cannot be limited under the British Columbia Business Practices and Consumer Protection Act or other applicable Canadian consumer protection law.

Use of this site

You agree not to use this site for any unlawful purpose, not to attempt to gain unauthorised access to any part of it, and not to scrape, copy, or republish its content without our written permission. Product images, descriptions, and site content are the property of Memory Canada or its suppliers and are protected by copyright. Brand names and logos are the property of their respective owners.

Governing law

These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply there. Any dispute will be brought in the courts of British Columbia.
